Terms and Conditions
1: These terms and conditions of engagement forms a control for services and sets out the entire agreement between you (Doctor) & LocumCheck. Ltd (with the exception of details of the rate of pay for any assignment). These terms may be modified at any time in writing with or without prior notice. The following definitions apply: 1-1: Client refers to any person, firm, company or organization Requiring the services of a doctor from Locumcheck. Ltd. 1-2: Doctor refers to any doctor who has registered with Locumcheck. Ltd. In order to be supplied as a Locum to its clients. 1-3: Assignment refers to any activity in Ireland for which a client Seeks the services of a Locum doctor through Locumcheck. Ltd. 1-4: Rate refers to the hourly rate of pay agreed by Locumcheck. Ltd, And the doctor in respect of any assignment. 2: Locumcheck. Ltd supplies Locum Doctors to its clients. Locumcheck does not charge any fee for registration. Locumcheck. Ltd will try to find doctors assignments in accordance with these terms and conditions. Doctors are not obliged to accept these assignments. The company may terminate the contract at any time. LocumCheck. Ltd charges 4.5% service charges to doctors in respect of each locum. 3: The relationship between LocumCheck. Ltd and the doctor is not one of full time employment. LocumCheck. Ltd is under no obligation to provide any minimum period or number of assignments to the doctor. LocumCheck. Ltd reserves the right to review your suitability for an assignment at any time (even during the course of assignment). 4: LocumCheck will explain the rate of pay to the doctor prior to the start of any assignment. Once agreed the doctor shall receive the rate of pay in writing or email, which signifies your agreement in accordance to said rate as such. Once the rate of pay is agreed it shall be changed only at the discretion of the LocumCheck. Ltd. 5: Doctors shall be paid in the arrears at the agreed rate of pay for the total hours worked during an assignment. This will be paid on receiving payment from the employing hospital, as per assignment, and due time for processing the same by LocumCheck. Ltd. LocumCheck. Ltd shall be under no obligation to pay the doctor with out receiving the due pay from the employing client. 6: LocumCheck. Ltd is purely a locum agency. It only facilitates doctors in acquiring a locum placement. All doctors are self employed Medical practitioners and so are responsible for paying their own tax returns with the revenue Department. LocumCheck, on Locum Doctor Request, can assist doctors in paying their annual returns at end of year by providing the total income earned via Locumcheck. 7: The doctor must be permitted by theGMC or IMC to work us locum doctor or be fully registered with Irish Medical Council (IMC) throughout the assignment. The doctor must inform LocumCheck. Ltd immediately if there is any change in the Status of their registration with the medical council. The doctor agrees that no payment will be claimed if medical council registration is not kept valid during the course of any assignment. 8: LocumCheck. Ltd or the client shall not be responsible for costs of travel or Accommodation or reimbursements of expenses incurred, unless specifically agreed with the LocumCheck. Ltd before the commencement of an assignment. 9: While in service the doctor agrees to: 9-1: Not engage in any conduct detrimental to the client or LocumCheck. Ltd. 9-2: Observe any disciplinary rules or obligations in force on the client s workplace. 9-3: Conform to the normal hours of work for the client s workplace (unless Arrangements have been made in advance to the contrary with both Locumcheck. Ltd and the client). 9-4: Be paid for the hours actually worked by the doctor. 9-5: Take all the reasonable steps while working for the client to safeguard your own safety and the safety of others who may be present or affected by your actions during the assignment and comply with the health and safety policy of the client. 10-: By accepting an assignment under these terms the doctor accepts that Locumcheck Pvt. Ltd will provide pay in accordance with the terms but Locumcheck. Ltd has no obligation to provide any other benefit or provide insurance in respect of the assignment. The doctor should indemnify themselves for these Locums under The Clinical Indemnity scheme on start of each Locum in writing or filling out appropriate St. Paul s Forms in Hospital. W e recommends all doctors to take extra medical insurance for these locums posts from any of the Medical Insurance Company. 11-: The doctor accepts assignments on the undertaking that he/she will work the post through Locumcheck. Ltd. If the doctor arranges that the assignment and part of or extension be put through another agency, locum bank or third party, the doctor will be liable to recompense LocumCheckLtd within one month upon demand for any losses LocumCheckLtd may suffer as a result. This will be equivalent to LocumCheckLtd commission for the part of the assignment that was not completed through LocumCheckLtd. 12-: The doctor must inform LocumCheckLtd immediately after finishing an Assignment if he/she accepts an appointment as a locum in an Establishment to which he/she was first introduced by LocumCheckLtd. 13-: LocumCheckLtd reserves the right to terminate your registration with LocumCheckLtd at any time without explanation and any prior notice, If the client deems your standard of work unacceptable they may also Terminate your contract while in an assignment. Should this be the Case no compensation can be claimed. 14-: The client may cancel an assignment at very short notice. LocumCheck Ltd will not be liable for any losses to the doctor in such cases. 15-: If for any reason the client changes your working hours (whether by Duration or timing), or the nature of your duties, your must inform LocumCheck immediately. 16-: The doctor agrees with LocumCheck. Ltd to deduct any amount of Moneys payable to him/her for any payment due, all sums which may be due from The doctor towards LocumCheck. Ltd how so ever incurring or arising. 17-: Doctors from outside the EEC must ensure that they have a valid Work visa, where appropriate to work in Ireland and must take their Passports, with them to each locum assignment. 18-:While accepting an assignment the doctor agrees not to exceed the Maximum average permitted hours under the junior doctor s deal Unless an Opt-out agreement from working time directives have Been signed. 19. LocumCheckshall in no way be responsible to the client for any false Declarations made by doctor. Be it fitness to practice, health Declaration, working time opt out agreement, immigration status Of non EU/ECC nationals. 20-: It is deemed that doctors accept these terms of engagement by virtue Of their acceptance of any assignment through LocumCheck. Ltd. 21-: The agreement between LocumCheck. Ltd & the doctor shall be Subject to and interpreted in accordance with Irish law and Locumcheck Pvt. Ltd.
